By accessing or using the website located at https://www.brnddrvn.com (the "Site") or completing the Brand Alignment Audit (the "Audit"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or the Audit.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BRNDDRVN ("we," "us," or "our").

BRNDDRVN provides brand clarity consulting, brand alignment audits, and related advisory services. The Site offers:

• A free Brand Alignment Audit consisting of six scored questions.
• Informational content about brand strategy and positioning.
• The ability to schedule a paid Strategy Call via a third party booking platform (Calendly).

Completion of the Audit does not create a client consultant relationship. A formal engagement begins only upon execution of a separate written agreement and receipt of payment.

When you complete the Brand Alignment Audit, you voluntarily provide your name, business name, and email address. By submitting the Audit, you:

• Consent to the collection and storage of your responses and contact information.
• Acknowledge that your results are generated algorithmically based on your answers and are for informational purposes only.
• Agree that BRNDDRVN may contact you at the email address provided to follow up regarding your results or services.

Audit results are not a substitute for professional brand consulting. We make no guarantee that implementing any recommendation will produce specific business outcomes.

All content on the Site — including text, graphics, logos, page layouts, and the Audit methodology — is the exclusive property of BRNDDRVN and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Site content without prior written permission from BRNDDRVN.

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law.
• Submit false, misleading, or fraudulent information in the Audit or any contact form.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.
• Scrape, crawl, or otherwise extract data from the Site by automated means without written consent.
• Interfere with or disrupt the integrity or performance of the Site.

The Site integrates with third party services including Calendly for appointment scheduling. Your use of those services is governed by their respective terms of service and privacy policies. BRNDDRVN is not responsible for the practices or content of any third party service.

THE SITE AND ALL CONTENT, INCLUDING AUDIT RESULTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON INFRINGEMENT.

BRNDDRVN does not warrant that the Site will be uninterrupted, error free, or free of viruses or other harmful components.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRNDDRVN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless BRNDDRVN and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any third party rights.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising under these Terms shall first be subject to good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BRNDDRVN with respect to the Site and supersede all prior agreements, representations, and understandings.
